Morocco has repeatedly stressed that any future agreement with the EU must respect the territorial integrity of the kingdom which includes the Western Sahara.

The kingdom says it does not consider itself in any way concerned or bound by Friday’s ruling by the European Court of Justice on the agricultural and fisheries agreements.

Its Foreign Affairs ministry stressed that the kingdom did not take part in any phase of the legal proceedings.

“Morocco is not a party to this affair, which concerns the European Union, on the one hand, and the “Polisario”, supported by Algeria, on the other. Morocco has not participated in any of the stages of this procedure and therefore does not consider itself to be affected by the decision,” the ministry stated in a statement.

It said “the content of this decision contains obvious legal errors and suspicious factual errors,” adding that “this indicates, at best, a total ignorance of the realities of the case, if not blatant political bias.”

In this sense, the ministry said, “the court has even taken the liberty of substituting itself for the competent UN bodies and contradicting their well-established positions and approaches. Moreover, the British High Court, in a similar case, had shown in all respects more discernment, impartiality and legal mastery.”

According to the statement “Morocco demands that the Council, the European Commission and the EU Member States take the necessary measures to respect their international commitments, preserve the achievements of the partnership and provide the kingdom with the legal certainty to which it is legitimately entitled as a partner of the EU on several strategic issues.”

In this context it concluded that “Morocco reiterates its constant position of not signing any agreement or legal instrument that does not respect its territorial integrity and national unity.”
